In our Terms and Conditions we have used “we” or “AdPlan” for AdPlan Marketing Pty Ltd, “you” or “user” for our user and “service” for everything that we do in connection with our site. Our service to you is subject to the following Terms and Conditions.
AdPlan provides Media providers who offer advertising space an online searchable database where users can search, review and book advertising space. Unless explicitly stated otherwise, any new features that augment or enhance the current service, including the release of new AdPlan resources shall be subject to the Terms and Conditions.
In consideration of use of the Service, you agree to provide true, accurate, current and complete information about yourself as prompted by the Service’s registration form. You also agree to use the site in the nature of which it was designed, with good intentions and in a way which will not bring AdPlan into disrepute.
Your privacy is important to us – please refer to AdPlan’s Privacy Policy available on the AdPlan.com.au site.
You understand that anything that you use on the AdPlan site (“Content”) whether publicly posted or privately transmitted, is the sole responsibility of the person from which such Content originated. You understand and consent to use this information at your own risk and acknowledge that the information may not necessarily be correct or accurate. This means that you, and not AdPlan, are entirely responsible for all Content that you upload, post or otherwise transmit via the Service.

Users must comply with all standards used across the site. This includes biographical or profile information to be written in the “third person” and all categories and sections to be used for their correct purpose. Contact information such as phone, fax and email must be placed only in the spaces designated for this purpose.
AdPlan reserves the right to edit or remove content loaded by a User. If content is edited or removed, all efforts will be made to notify the User by email.
AdPlan does not claim ownership of the Content you place on the AdPlan site. By submitting Content to AdPlan for inclusion on the AdPlan Site, you grant AdPlan a license to use the Content solely for the purpose of displaying, distributing and promoting your product or service. This will terminate at the time your AdPlan information is terminated. You acknowledge that AdPlan has the right to refuse or remove any Content from the AdPlan site.
You may not upload any material or files to AdPlan unless you have the right or appropriate consent to do so. If you do not own the material you must get the owner’s consent before you post or upload it.
You agree to indemnify and hold AdPlan, and its officers, employees and agents harmless from any claim or demand, including legal fees, made by any third part due to or arising out of your Content, your use of the Service, your connection the Service, your violation of the Terms and Conditions, or your violation of any rights of another person.

You agree to pay AdPlan’s charges for use of the Service as set out on the AdPlan site and any agreements previously met between yourself and AdPlan. We may change our charges from time to time without notice by publishing the revised charges on the AdPlan site. You will pay our invoices within 21 days of the date printed on each invoice. Any expenses, disbursements and legal costs incurred by AdPlan in the enforcement of any rights contained in the contract shall be paid by the User, including any reasonable solicitors fees or debt collection agency fees.
If you do not meet any responsibility of yours under these Terms and Conditions we may terminate your password, AdPlan account or use of the Site and remove and discard any Content from the Service.
AdPlan has the right to run advertisements and promotions on anywhere on the AdPlan Site including on any page dedicated to advertising space available, suppliers or ad space booked using the Service. AdPlan may run such advertisements and promotions in the manner mode and to the extent chosen by AdPlan. You agree that AdPlan shall not be responsible or liable to you or anyone else for any loss or damage of any kind incurred as the result of any dealings with or as the result of such advertisements and promotions on the Service.
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because AdPlan has no control over such sites and resources, you acknowledge and agree that AdPlan is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from sites or resources.
AdPlan, its officers, employees and agents shall not be liable to you or anyone else for any loss or injury resulting from the use of the Service caused in whole or in part by its negligence or contingencies beyond its control in use of the Service. In no event will AdPlan its officers, employees and agents be liable to you or anyone else for any consequential, special, incidental, indirect or similar damages resulting from the use of or inability to use the Service. You agree that the liability of AdPlan, if any, arising out of any legal claim (whether in contract, tort or otherwise) in any way connected with the Service of the content of the Service shall in no way exceed the amount that you paid AdPlan for the use of the Service. You acknowledge that you are using the Service for the purpose of a business and that the Consumer Guarantees Act does not apply to our provision of the Service to you.
All our Services are provided in Australia under Australian law. You submit to the jurisdiction of the Australian courts.
